Preamble
These Terms and Conditions of Use (the "Terms") govern the access to and use of the website www.lodaites.ae (the "Website"), published by LODAITES PERFUMES & COSMETICS TRADING LLC (the "Publisher").
The Website is made available to provide information about the Company and its products and/or services and to enable users to access the Company's e-commerce platform.
The conditions governing the purchase of products are set out separately in the Terms of Sale, which apply in addition to these Terms.
By accessing or using the Website, the user ("User") acknowledges having read, understood and accepted these Terms without reservation.
The Publisher reserves the right to modify these Terms at any time. The applicable version is the one published on the Website at the time of use. Users are therefore invited to consult them regularly.
Article 1 – Access to the Website
Access to the Website is reserved for individuals with full legal capacity. Minors may access the Website only under the responsibility and supervision of a parent or legal guardian.
The Publisher shall not be held liable for any use of the Website in violation of these conditions.
Article 2 – User Accounts
Browsing the Website does not require the creation of a personal account. However, certain services (such as placing an order, accessing order history or receiving newsletters) may require account creation.
When creating an account, the User undertakes to provide accurate and complete information and to keep it up-to-date.
The User is solely responsible for maintaining the confidentiality of their login credentials. Any action carried out via the User's account is deemed to have been carried out by the User. The Publisher cannot be held liable for unauthorized access to a User account resulting from negligence or disclosure of credentials.

Article 3 – User Obligations
3.1 Intellectual Property
All elements of the Website, including but not limited to texts, visuals, images, photographs, videos, sounds, graphics, logos, trademarks, databases, software and overall structure, are protected by intellectual property rights and are the exclusive property of LODAITES PERFUMES & COSMETICS TRADING LLC or its licensors.
Access to the Website does not grant the User any ownership or usage rights over these elements.
Any reproduction, representation, modification, extraction, distribution or exploitation, in whole or in part, of the Website or any of its elements, by any means whatsoever and on any medium whatsoever, without prior written authorization, is strictly prohibited.
This includes, in particular (but not exclusively):

- framing or use of meta-tags using the Publisher’s trademarks or names.
Any unauthorized use may result in civil and/or criminal proceedings.

The User undertakes not to engage in any conduct that may harm the Website, the Publisher or other users, including but not limited to:
- unlawful, fraudulent or abusive activities;
- attempts to interfere with the proper functioning or security of the Website;
- introduction of malicious software or code;
- infringement of third-party rights;
- defamatory, offensive or misleading behavior.
Article 4 – Limitation of Liability
The Website is provided "as is". The Publisher does not guarantee that the Website will be accessible at all times, free from errors or interruptions.
To the maximum extent permitted by applicable law, LODAITES PERFUMES & COSMETICS TRADING LLC shall not be held liable for any direct or indirect damage, including loss of data, loss of profits or business interruption, resulting from access to or use of the Website.
The Publisher shall not be liable for content, products or services offered on third party websites via hyperlinks on the Website. The User acknowledges that the Publisher has no control over such external content.

The Publisher reserves the right, at its sole discretion and without prior notice, to suspend or terminate access to the Website for any user who violates these Terms or applicable laws.
Article 6 – Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict-of-law rules.
Any dispute arising out of or in connection with the use of the Website shall be subject to the exclusive jurisdiction of the competent courts of the Emirate of Dubai, unless mandatory legal provisions provide otherwise.
